Рассмотрена концепция прав человека, сформировавшаяся в Германской Демократической Республике, приведены точки зрения восточно-­немецких ученых относительно понимания таких прав. Не все исследователи выступали за их существование в социализме. Среди юристов, выступавших за существование прав человека в социализме, не наблюдается консенсуса относительно понятия этих прав. Мнения расходятся также в вопросе континуитета – дисконтинуитета буржуазных и социалистических прав человека. Одни считают, что категории таких прав отсутствуют в действительности. Другие – что социалистические основные права человека являются продуктом социалистической революции, а не некой лучшей реализацией унаследованных прав человека. В этом выражается дисконтинуитет буржуазных и социалистических прав человека. Встречается идея о единстве континуитета и дисконтинуитета. Важное место в концепции социалистических прав человека занимает принцип единства прав и обязанностей: они являются двумя сторонами одного и того же предмета. Права могут быть реализованы только тогда, когда на гражданина возложены обязанности. Установлено, что общее идеологическое основание (идеология марксизма-­ленинизма) не является препятствием для разнообразия мнений в восточно-немецкой дискуссии о правах человека.

This article describes the concept of human rights that emerged in the German Democratic Republic through the pluralism of the doctrine of East German jurists. Some scholars denied human rights in socialism while others had no consensus regarding the concept. They had different opinions on continuity / discontinuity of bourgeois and socialist human rights. Some scientists believed that these categories did not exist in reality. Others argued that socialist basic human rights were the product of the socialist revolution rather than an improved realization of inherited human rights, which revealed the discontinuity of bourgeois and socialist human rights. East German philosophers also had an idea of the unity of continuity and discontinuity. The principle of the unity of rights and obligations was of paramount importance in the concept of socialist human rights as two sides of the same subject because rights can only be realized when the citizen is entrusted with obligations. Therefore, the ideology of Marxism-Leninism did not prevent the East German researchers from developing different opinions on human rights.
